HEALTH AND SAFETY NOTICE
At Accord Laboratory Supplies Ltd, (hereafter also referred to as “Accord Labs” “we” “us” or “our”). Accord Labs undertakes to comply with health and safety law, including, but not limited to the provision of safety data sheets (where applicable) and other information to secure, so far as is reasonably practicable, the health and safety of the users of the Goods.
The customer will comply with health and safety law and agrees to indemnify and keep indemnified, Accord Labs against the customer’s failure to comply with health and safety law. In particular, the Customer shall indemnify Accord Labs against any claims or proceedings resulting from any injury, loss or damage caused by a failure to use the Goods in accordance with Accord Labss instructions (whether such failure is on the part of the Customer’s employees, contractors or agents or a third party to whom the Customer has supplied the Goods).
The Customer undertakes to ensure that all information provided or made available with the Goods to the Customer concerning the use, handling, processing, storage or, transportation of the Goods (hereinafter “use of Goods”), including in particular all information concerning any risks to health and safety to which use of Goods my give rise and any conditions necessary to ensure that the Use of Goods will be without health risks, shall be brought to the attention of all employees (if applicable) of the Customer and others involved in Use of Goods. The Customer undertakes further to impose a similar requirement upon any third party to whom the Goods are sold or supplied.
All Goods are sold on the basis that the Customer will take notice of the care and handling recommendations supplied to it, or failing such recommendations, follow the highest standards of care adopted in respect of such Goods and the Customer accepts sole responsibility for taking such care and the safe use of the Goods. If the Customer is not already in possession of literature or information in connection with the safe use of the Goods, then the Customer should contact Accord Labs.
The Customer agrees to indemnify Accord Labs against any liability to which the Company may be subject by reason of the Customer’s breach of this condition and promptly to inform Accord Labs of any incident of which the Customer becomes aware in which the Use of Goods has or, may have given rise to risks to the health or safety of any person.
LIABILITY AND DISCLAIMER
It is important to understand that once products leave Accord Labs, how the product is used is your responsibility, and any damaged e.g. to property, equipment, caused associated is not at fault by Accord Labs. We can only compensate with the replacement of the product where deemed fit.
This unit is intended for LEGAL purposes only, to be used in accordance with local laws and regulations. You warrant that you have received adequate information regarding the goods to ensure their safe use: indoor and outdoor, handling and storage in compliance with applicable local laws, and ensure that the goods are handled responsibly.
For Canadian Customers:
Please note that TC would only accept only the outdoor usage of these units unless their fertility is in compliance with local laws and applicable safety measures. Accord Labs shall not be liable to anyone for the misuse of the items to the maximum extent permitted by applicable laws.
